Overview
With over twenty years of experience as a commercial litigator in the real estate industry, Mr. Regan has handled a vast array of real estate litigation matters: commercial foreclosures and lender liability claims, partnership disputes and petitions for dissolution, commercial lease disputes, declaratory judgment actions to resolve competing claims of ownership, specific performance claims, Yellowstone applications, all manner of condominium and co-op disputes, construction disputes, partition actions, and claims of adverse possession, easement and appurtenant rights.
Mr. Regan also served as in-house General Counsel to a New York real estate developer and, as the only lawyer at the company, provided daily advice to ownership and executives on a broad spectrum of legal matters across the client’s extensive real estate portfolio relating to complex loan and lease documents, construction agreements, purchase agreements, and more, and personally represented the company in dozens of real estate litigation matters in New York courts.

Prior Experience
PRIOR EXPERIENCE
Before joining MSF, Mr. Regan was a litigation partner in an AM Law 200 firm and served as General Counsel to a real estate investment, operating, management and development company based in New York City, with properties in New York, Massachusetts, Connecticut and Texas.
Representative Matters
- Representing lenders in several actions to enforce guaranties in the Commercial Division, New York County.
- Representing REIT with respect to foreclosure and various other legal matters.
- Representing JV member in breach of contract dispute pending in the Commercial Division, New York County.
- Representing real estate investment company in litigation pending in Austin, Texas regarding a buyout provision in the parties’ agreement.
- Defending lender against panoply of claims arising out of a development project in the Commercial Division, New York County.
- Obtained summary judgment for client resolving ownership of various companies owning real property in the Commercial Division, New York County.
- Obtained summary judgment for client in dispute settling ownership of a building in the Flatiron District of Manhattan; affirmed on appeal.
- Defended borrower and guarantors in mortgage foreclosure action in the Commercial Division, New York County.
- Negotiated division of real estate holdings in connection with partnership dispute in the Commercial Division, New York County.

New York City Bar Association
Mr. Regan is an active member of the New York City Bar Association and has served as Chair of the State Courts Committee and Council on Judicial Administration. In 2019, Mr. Regan organized an event at the City Bar paying tribute to several recently retired Commercial Division Justices. In 2020, as Chair of the CJA, Mr. Regan testified before the New York State Assembly’s Standing Committee on the Judiciary regarding budget and staffing reductions in the Judiciary, particularly with respect to the certification of senior judges. Mr. Regan has also participated in panel discussions at the City Bar, including a panel discussion with other lawyers and judges regarding the application of the Commercial Division Rules to the General I.A.S. Parts.
Currently, Mr. Regan is serving as Co-Chair of a City Bar Working Group tasked with examining the nomination process for adding judges to the New York Court of Appeals. In June 2024, Mr. Regan was appointed by the City Bar to the New York State Bar Association House of Delegates.
